New Jersey license types eligible for cocktails to-go

To-go cocktail privileges attach to specific retail consumption license categories. If your license is not one of them, the packaging questions never come up.

The short answer

Permanent cocktails-to-go privileges apply to plenary retail consumption licenses, plenary retail consumption licenses used in connection with hotels or motels, and seasonal retail consumption licenses. Other classes should not be assumed eligible.

Eligible license categories

Plenary retail consumption license

The standard full-service license held by most restaurants, bars and taverns serving spirits on premises.

Plenary retail consumption license used with a hotel or motel

The same privileges where the license is tied to hotel or motel operations.

Seasonal retail consumption license

Shore and seasonal operations holding a seasonal retail consumption license.

If you are not sure which license you hold

  1. Look at the license certificate posted on your premises and note the class wording.
  2. Compare that wording, not your business type, to the categories above.
  3. If the wording does not clearly match, confirm your class with the New Jersey Division of Alcoholic Beverage Control before selling cocktails to-go.

We will not guess for you

When a license class cannot be mapped confidently, our checker returns a verify result rather than a pass. A false pass on license eligibility is the most expensive mistake in this area.
