NJ ABC guidance on cocktails to-go

The 2020 ABC advisory is still the most detailed practical guidance available on packaging, seals and labels, and it is also partly out of date. Both facts matter.

Regulations in our system last verified on August 29, 2026

The short answer

Treat the advisory’s descriptions of tamper-evident closures, unacceptable disposable cups, label content and public consumption as current practical guidance. Do not rely on its statement that third-party services may not deliver cocktails to-go; the 2026 statute supersedes that.

Why we mark it partially superseded

Our regulatory database ranks sources by authority. Where guidance conflicts with the statute, the statute governs and the guidance provision is retired from the rule set while the rest of the document stays in force.

Definition / Examples of Tamper-Evident Packaging

ABC guidance

Current available NJ ABC guidance describes a tamper-evident seal as one that indicates whether the seal or closure has been interfered with or removed, and gives examples such as crown caps, breakaway screw tops, heat-sealed closures and sealed pouches.

What to do: Compare your closure to the examples ABC has described and choose one that visibly shows interference.

Problematic Disposable Cups

ABC guidance

Existing NJ ABC guidance does not treat ordinary disposable drink cups or lids with openings as acceptable cocktails-to-go containers.

What to do: Switch to a bottle, pouch or sturdy container with a tamper-evident closure and no openings.

Cocktail Label

ABC guidance

NJ ABC's existing cocktails-to-go guidance calls for the common or trade name of the cocktail and a notation that the container holds an alcoholic beverage.

What to do: Label each container with the drink name and the words ALCOHOLIC BEVERAGE. Handwritten labels are acceptable under this guidance.

Public Consumption

ABC guidance

Local alcohol-consumption rules may also apply. NJ ABC guidance notes that off-premises consumption remains subject to municipal and other laws covering sidewalks, beaches, parks and other public places.

What to do: Let customers know local alcohol-consumption rules may also apply.
