Terms of Use
Effective date: August 29, 2026 · Last updated: August 29, 2026
1.Eligibility and authority
The Service is intended for use by owners, operators, managers and advisors of licensed alcoholic beverage establishments and by their authorized personnel. You must be at least 21 years of age and legally capable of entering into contracts. If you use the Service on behalf of a business or other entity, you represent that you are authorized to bind that entity to these Terms, and “you” refers to both you and that entity.
2.No legal advice; no attorney-client relationship
Gopliancy is an information technology service, not a law firm, and it does not provide legal advice, legal opinions, regulatory representation or licensing services. Nothing on gopliancy.com — including any checklist, requirement card, status indicator, sample label, plain-English explanation or AI-generated response — constitutes legal advice or a legal determination about your business.
No attorney-client relationship, fiduciary relationship or consultant relationship is created by your use of the Service, by submitting information to it, or by communicating with us. Statutes, regulations, administrative advisories, municipal ordinances and enforcement practices change and are applied to specific facts. You are solely responsible for your compliance decisions and should consult the New Jersey Division of Alcoholic Beverage Control, your municipal issuing authority, and qualified legal counsel licensed in your jurisdiction before acting.
3.Scope of the Service and informational output
The Service asks structured questions about your establishment and compares your answers against a curated database of regulatory rules derived from published sources. Each generated report identifies the source relied upon, its effective date and the date our records were last verified. Reports are historical snapshots: they reflect the rule versions in our database at the time of generation and are not updated afterward. A report may display a notice indicating that underlying regulatory records have since changed.
The Service does not determine that you are “legally compliant,” does not file or maintain licenses or permits, does not monitor your operations, and does not deliver regulatory alerts unless expressly offered as a feature. Vendor, packaging and training listings are informational only; we do not endorse, certify, inspect or guarantee any third party, and some listings may be provided under commercial or affiliate arrangements.
4.Your responsibilities and accurate information
Reports are only as accurate as the information you supply. You agree to provide truthful, current and complete answers, including license type, location, product type, fulfillment methods and packaging. You agree not to submit information you are not authorized to share, and not to upload images or content containing personal data of third parties, confidential information of others, or unlawful material.
5.Acceptable use
You agree not to, and not to permit any person to:
- use the Service in violation of any applicable law, regulation or license condition;
- scrape, crawl, harvest, systematically download, mirror or otherwise extract the regulatory database, reports or listings, whether by automated means or otherwise;
- resell, sublicense, white-label or commercially redistribute the Service or its output without our prior written consent;
- probe, scan, penetration-test, circumvent authentication, access administrative areas, or access reports or records belonging to others;
- reverse engineer, decompile or attempt to derive the underlying rule logic, prompts or models except to the extent such restriction is prohibited by law;
- upload malware, interfere with the integrity or performance of the Service, or impose unreasonable load on our infrastructure;
- misrepresent the output of the Service as legal advice, as certification, or as an official government determination.
6.Report links and access tokens
Reports are accessible through a unique, unguessable link. Anyone holding that link can view the report. You are responsible for safeguarding your report links and for any disclosure resulting from sharing them. We may expire, regenerate or revoke links for security, abuse-prevention or operational reasons.
7.AI-assisted explanations
Certain features use automated language models to explain requirements already present in your report and in our source records. These features are constrained to explanation only and may decline to answer where our records are unverified or silent. Automated systems can produce incomplete or incorrect output. You must independently verify any statement before relying on it, and you must not treat any AI-generated text as a legal determination.
8.Intellectual property; limited license
The Service, including its software, interface design, compilation and structure of the regulatory database, rule wording, report formats, sample label templates, trademarks and the Gopliancy name and logo, is owned by us or our licensors and is protected by intellectual property laws. Underlying statutes, regulations and government publications are not owned by us; our selection, arrangement, coding, editorial summaries and presentation of that material are.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access the Service and to use and internally reproduce your own reports for your own business compliance purposes, including sharing them with your counsel, insurers, staff and regulators. All other rights are reserved.
9.Feedback
If you send suggestions or feedback, you grant us a perpetual, worldwide, royalty-free, irrevocable license to use it for any purpose without obligation or compensation.
10.Third-party links and services
The Service links to government sources, vendors and other third-party resources. We do not control those destinations and are not responsible for their content, availability, accuracy, pricing, products, privacy practices or conduct. Your dealings with any third party are solely between you and that third party.
11.Disclaimer of warranties
THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE OR ITS REGULATORY CONTENT IS ACCURATE, CURRENT, COMPLETE, ERROR-FREE, APPLICABLE TO YOUR CIRCUMSTANCES, OR SUFFICIENT TO ESTABLISH OR MAINTAIN COMPLIANCE, OR THAT ACCESS WILL BE UNINTERRUPTED OR SECURE. NO ADVICE OR INFORMATION OBTAINED FROM THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE.
12.Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, LICENSORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS INTERRUPTION, FINES, PENALTIES, LICENSE SUSPENSION OR REVOCATION, ENFORCEMENT ACTIONS, LEGAL FEES OR REGULATORY COSTS, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13.Indemnification
You will defend, indemnify and hold harmless Gopliancy and its officers, members, employees, contractors and licensors from and against any claims, demands, proceedings, losses, liabilities, fines, penalties, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service or reliance on its output; (b) your business operations, packaging, labeling, sales, delivery or licensing; (c) information or images you submit; (d) your breach of these Terms or of any law; or (e) your infringement of any third-party right.
14.Changes to the Service and to these Terms
We may modify, suspend or discontinue any part of the Service at any time. We may revise these Terms by posting an updated version with a new effective date; material changes will be reasonably indicated. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service.
15.Suspension and termination
We may suspend or terminate your access at any time, with or without notice, including for suspected violation of these Terms or misuse of the Service. Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, governing law and dispute resolution survive termination.
16.Governing law and venue
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of New Jersey, without regard to conflict of laws rules. Subject to the section below, you and we submit to the exclusive jurisdiction of the state and federal courts located in New Jersey, and waive any objection to venue or inconvenient forum.
17.Dispute resolution; informal resolution first
Before initiating any proceeding, you agree to contact us in writing and allow thirty (30) days to resolve the dispute informally. To the extent permitted by law, each party waives any right to a jury trial and to participate in a class, collective or representative action, and any claim must be brought in an individual capacity. Any claim relating to the Service must be filed within one (1) year after it arises, or it is permanently barred, except where a longer period is required by law.
18.Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede prior understandings. If any provision is held unenforceable, it will be limited or severed and the remainder will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Nothing in these Terms creates any partnership, agency, employment or joint venture. We are not liable for any failure or delay caused by events beyond our reasonable control.
19.Contact
Questions about these Terms may be sent to legal@gopliancy.com.
