Liquor license compliance for New Jersey to-go sales

Every to-go privilege in New Jersey runs through your license. Before you evaluate containers, confirm that the class you hold carries the privilege at all.

The short answer

To-go cocktail privileges attach to plenary retail consumption licenses, hotel/motel plenary retail consumption licenses and seasonal retail consumption licenses. Any other class should be confirmed with the New Jersey Division of Alcoholic Beverage Control before you sell.

What to have on hand

License certificate
The posted certificate with the exact class wording
License number
Needed for any ABC inquiry about your privileges
Municipality
Local rules can affect hours and public consumption
Renewal status
To-go privileges depend on an active license

Business type is not license class

“We are a restaurant” does not establish eligibility. The class printed on the license does. Two neighboring businesses that look identical can hold different classes.

Keeping the license side clean

  1. Store a copy of your certificate with your to-go compliance records.
  2. Re-check privileges after any license transfer, renewal issue or change of ownership.
  3. Re-run a compliance check when the statute or ABC guidance changes.
