New Jersey alcohol-to-go laws

“Alcohol to-go” covers several different products with different rules. This page separates them so you know which set of requirements you are actually reading.

The short answer

New Jersey’s permanent to-go provision is written around mixed drinks containing distilled alcoholic beverages sold in closed, sealed containers. It also restricts delivering alcoholic beverages in their original containers, other than malt alcoholic beverages.

Mixed drinks and cocktails

This is the fully mapped area in our regulatory database. Eligible licensees may sell mixed drinks containing distilled alcoholic beverages for off-premises consumption in closed and sealed containers, subject to the tamper-evident seal and 16 fluid ounce cap.

Original containers of spirits and wine

Under the cocktails-to-go delivery provision, alcoholic beverages generally may not be delivered in their original sealed or unsealed containers, except for malt alcoholic beverages. Retail sale of packaged goods is governed by the privileges of your license class, which is a separate question from the to-go cocktail provision.

Beer and malt beverages

Malt alcoholic beverages are carved out of the original container delivery restriction. What your license permits you to sell in packaged form still governs, so confirm your class before assuming a beer to-go program is covered.

What our checker covers today

Our compliance engine gives definitive, cited answers for cocktails containing distilled spirits. For beer, wine and original-container spirits we return a verify result rather than a pass, because those depend on license privileges we do not yet model.
